Acceptance of Terms

By accessing or using the services provided by MacAI HK ("we", "us", "our"), including our websites at aihk.io and macai.io, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, clients, and users of our AI configuration services, hardware bundles, and support plans.

Services Description

MacAI HK provides the following services:

  • BYOM (Bring Your Own Mac) AI Upgrade — Installation, configuration, and optimisation of open-source AI software on your existing Mac with Apple Silicon (M1 or later)
  • Pre-Configured AI Mac Bundles — Purchase of Mac hardware pre-installed with a comprehensive AI software suite, available in Essentials, Professional, and Enterprise tiers
  • Support Plans — Ongoing monthly or quarterly support, model updates, and maintenance services
  • Custom AI Development — Bespoke AI workflow creation, RAG pipeline setup, custom model fine-tuning, and training sessions

All AI software we install is open-source and runs entirely on local hardware. We are an AI configuration service and do not develop or license the underlying AI software.

Payment Terms

  • Currency — All prices are quoted in Hong Kong Dollars (HKD) unless otherwise stated
  • Payment Timing — Full payment is required before service delivery for BYOM upgrades and hardware bundles. Support plans are billed in advance on a monthly or quarterly basis.
  • Payment Methods — We accept bank transfer, FPS, and major credit/debit cards through our secure payment processors
  • Invoicing — An official invoice will be provided for all transactions. Corporate clients may request custom invoicing arrangements.
  • Late Payment — Overdue invoices may incur a late payment fee of 2% per month on the outstanding balance

Service Delivery

  • Setup Time — BYOM upgrades are typically completed within 1-5 business days, depending on the service tier and complexity
  • Delivery Methods — Services can be delivered in-person (Hong Kong) or via secure remote access, as agreed during the assessment
  • Hardware Bundles — Pre-configured hardware bundles are available for collection or delivery within Hong Kong. International shipping may be arranged at additional cost.
  • Client Responsibilities — For BYOM services, you must provide a Mac with Apple Silicon (M1 or later), ensure adequate storage space, and back up all important data before service begins
  • Remote Access — For remote services, you must provide stable internet access and install any remote access software we specify. We will only access your system during agreed service windows.

Hardware

For pre-configured AI Mac bundles:

  • Apple Warranty — All Mac hardware is covered by Apple's standard warranty. MacAI HK does not provide hardware warranties — any hardware issues should be directed to Apple or an Apple Authorised Service Provider.
  • Configuration Warranty — We warrant our software configuration work, not the underlying hardware. See the Warranty & Support section for details.
  • Compatibility — Our services require Mac hardware with Apple Silicon (M1 chip or later). Minimum 8GB unified memory for basic setup; 16GB+ recommended; 32GB+ for enterprise workloads.

Software

All AI software installed as part of our services is open-source and distributed under their respective licences (MIT, Apache 2.0, Meta Community License, and others).

  • Open-Source Licences — We configure but do not own or license the underlying AI software. You are responsible for complying with each software's licence terms.
  • Updates — AI models and software evolve rapidly. Our configuration is based on the best available versions at the time of service. Future updates may be obtained through our support plans or self-managed.
  • No Guarantee of Output — AI models generate outputs based on statistical patterns. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for any particular purpose.

Warranty & Support

Configuration Warranty

  • Essential Tier — 14-day configuration warranty from date of delivery
  • Professional Tier — 30-day configuration warranty from date of delivery
  • Enterprise Tier — 90-day configuration warranty from date of delivery

Configuration warranty covers defects in our setup work. It does not cover issues caused by macOS updates, user modifications to configured software, hardware failures, or third-party software conflicts.

Optional Support Plans

  • Monthly Support — HK$49-$199/month for ongoing assistance, troubleshooting, and minor configuration adjustments
  • Model Update Subscription — HK$29-$99/quarter for regular updates to AI models and optimisation of existing configurations

Limitation of Liability

To the maximum extent permitted by Hong Kong law:

  • Data Loss — MacAI HK is not liable for any data loss during service. Clients are required to back up all data before service begins. We recommend Time Machine or equivalent backup solutions.
  • Hardware Failure — We are not liable for hardware failures, defects, or damage not caused by our service work
  • Open-Source Software — We are not liable for bugs, vulnerabilities, or issues in open-source AI software that we configure. These tools are provided "as is" under their respective licences.
  • AI Output — We are not liable for decisions made based on AI-generated content. AI outputs should be reviewed and verified by qualified humans before use in critical applications.
  • Maximum Liability — Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service in question

Refund Policy

  • Before Service Begins — Full refund if you cancel before we commence any configuration work
  • Service In Progress — Partial refund (pro-rated based on work completed) if you cancel while service is underway
  • After Completion — No refund after service has been completed and delivered. Configuration warranty applies for defects in our work.
  • Hardware Bundles — Hardware returns are subject to a 15% restocking fee. Hardware must be returned in original condition within 7 days of delivery. Apple's own return policy may also apply.
  • Support Plans — Monthly support plans may be cancelled at any time with effect from the next billing cycle. No refunds for the current billing period.

Intellectual Property

  • Our Brand — "MacAI HK", the MacAI logo, and associated branding are our intellectual property. You may not use our branding without written permission.
  • Apple Trademarks — Mac, Mac mini, Mac Studio, macOS, and Apple Silicon are trademarks of Apple Inc. MacAI HK is not affiliated with, endorsed by, or authorised by Apple Inc.
  • Open-Source Software — All AI software we install remains the intellectual property of their respective creators and is governed by their open-source licences
  • Custom Work — Any custom configurations, workflows, or scripts created specifically for you as part of our Custom AI Development service are owned by you upon full payment

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR).

Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Changes to These Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practical, notify affected clients by email.

Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
